The objections of Trademark Application are given under Section 9 & 11 of the Trade Mark Act, 1999, where the application is examine by the Examiner to make a examination report. The Trade Mark Examiner can raise an objection on following grounds.
· Trademark is devoid of any distinctive character and not capable of distinguishing the goods or services of one person to other.
· When same or similar trademark exist.
· When trademark is deceptive.
· If nature of the mark can cause confusion to public.
· It comprise of things which can hurt religious sentiments
· Contains scandalous or obscene matter
· Prohibited under Prevention of Improper Use Act, 1950
· When shape of good is result from Nature.
